  • “Prop Konnect” refers to the brand name under SNAL Digital Media which is a face for the customers to hunt and buy the property and a marketplace for our real estate business partners to showcase and promote their projects and properties in front of potential buyers.
  • “Special Terms” means whatever specifics, requirements, and terms that the parties have agreed upon in order to depart from these Terms.
  • “Sensitive Information” means Users passwords, Social Security numbers; passports; driver's licenses; Aadhar numbers; or similar identifiers; information about political views; religious or philosophical beliefs; trade union membership; physical, physiological, or mental health condition or information; medical records and history; sexual orientation; genetic data; biometric information; or other employment, financial, or health information; and any information subject to laws, regulations, or industry standards designed to protect data privacy and security, such as the Health Insurance Portability and Accountability Act and the Payment Card Industry Data Security Standards.
  • “Follow Ups” refers to the User and client interactions, giving the desired solution to customer queries from client or PropKonnect team to help them in finalization of their dream property.
  • “Deals & Discount Offer” refers to the discount that Propkonnect is offering when purchasing a channel partner plan, according to the specific terms and circumstances of the arrangement.
  • “Plan type” refers to the different free/paid plans designed for channel partners, categorized on Monthly, Half-yearly & Yearly payment plans.
  • “Plan payments” has a set timetable and expiration dates and refers to the payments made against the plans of responsive channel partners. It is advised to double-check the plan details prior to buying.
  • “Free Trial” designed to give a feel of the different plans designed for channel partners, free-trial comes with specific duration. It is advised to double-check the details according to the plan you want to purchase.
  • “Plan features/guidelines” refers to the various features, choices, and facilities for use that vary depending on the plan.
  • “Plan services” refers to different services like payments, validity, features, support and others.

The Terms take effect as soon as one of the following happens first:

  • the person receives from Supplier confirmation that the account has been created and the login credentials needed to access the account; or
  • for those PropKonnect’s Services and sections of the website that don't require the creation of an account, the Terms take effect at the time of accessing those sections and services.

You are not permitted to use the PropKonnect Services without the previous written authorization of Supplier.

  • if you are a competitor of PropKonnect
  • for production purposes,
  • for benchmarking or competitive purposes, such as keeping an eye on the functioning, performance, or availability of the PropKonnect Services

Registration

  • A person/individual broker/channel partner/company who registers on our website and create any type of acount with us to inquire about or to buy property from our partner builders/project owners and from our business partners, either personally or on behalf of their organization. To use our products and services, account creation is a necessary type of action. We reserve the right, but not the responsibility, to confirm the information provided on our website when registering. We maintain the right to refuse any person's application for registration without providing a reason.
  • By creating an account on our website, you agree that you are solely responsible for maintaining the confidentiality of the information associated with that account, including the password you choose. Additionally, you consent to being accountable for everything you do on the website after registering. You must notify us right away via the account portion of the website if You think, or have reason to believe, that Your password is no longer secure. Any information you supply us can be updated by visiting the website's account section. We provide digital marketing advertising and promotional services to all our clients/business partners to give them more visibility and more potential customers who are interested in their projects to purchase.
  • PropKonnect advertise real estate projects from India, Dubai and from different other countries.
  • The Website provides for seamless enquiry procedure and solution basis on the enquiry through our website, choose projects, decide your preferred location and project type.
  • PropKonnect on a best effort basis verifies the authenticity of each User registered on the Website by verifying the ‘know your client’ documents uploaded by such User. However, PropKonnect is not responsible to verify the authenticity of the information and documents provided by any User.
  • It is pertinent to mention here that, PropKonnect itself does not own/regulate the Registered Users and neither does there exist any employer/employee relation between them. It is the User who shall render the required product to you as per the relevant information submitted with PropKonnect while registering on the Website.
  • The different builders and project listings on Propkonnect.com are for information purpose and our team use to collect the data from different sources online & offline and we always try to provide the accurate information about the data displayed on our web portal. But, at the same time we are not giving a 100% authentication of the data as the figures and facts use to change regularly from the builders and projects owners. The prices are subject to the terms of respective project owners and they reserve the right to modify them without giving the prior notice.

Indemnity and Limitation of Liability

  • You hereby undertake to defend, indemnify, and hold harmless PropKonnect, its affiliates, and each of their officers, directors, employees, and agents against any and all liabilities, losses, costs, and expenses resulting from or arising out of any claims. (i) about any information submitted, displayed, or otherwise conveyed on the website, including any infringement or violation of intellectual property rights belonging to third parties, allegations of defamation, invasions of privacy, rights to publicity, or unfair competition; or
    (ii) that any project our clients offer for advertise and sale violates a third party's patent or trademark; or
    (iii) any claim that the products our clients sell or the services they provide, or that any such claim is connected to the use of the products our clients sell or the services our partners provide, resulted in harm or damage to any User; or
    (iv) any quantity, or claim-related claims pertaining to any project or services rendered by our client;
    (v) the failure to fulfill any partner obligations under a separate agreement entered into with any User regarding the sale of project or the inventory, or the violation of any warranties, representations, or undertakings, or resulting from Your violation of any applicable laws; or
    (vi) pertaining to goods or services you've purchased; or
    (vii) a payment default by you; or
    (vii) violation of your timely payments before handover of the project regarding the purchased property that You have purchased or
    (viii) Your use of Assisted Trade Service; or
    (ix) breach of the terms of these Terms of Use.
  • PropKonnect makes no representations or guarantees regarding the availability, accuracy, or total security of the Services. You recognize and accept that there are risks associated with operating conditions, Internet connectivity, third-party software components, and other factors outside of PropKonnect control that could lead to the loss of any other information related to transactions made through the Website, as well as the possibility of Content or Service unavailability.
  • PropKonnect disclaims all warranties, including the implicit warranties of merchantability, that are not specifically mentioned in these Terms of Use, to the extent allowed by relevant law.
  • PropKonnect, its employees, agents, suppliers, or affiliates shall not be liable to You or Your employees, agents, suppliers, or affiliates for any lost profits or indirect, special, incidental, consequential, or other loss or damage of any kind arising in connection with the provision of Services, or for damages that could have been avoided by the use of reasonable diligence, even if PropKonnect has been advised or should have known that such damages could occur. PropKonnect will never be responsible to you for any intentional harm.

  • However, notwithstanding anything, PropKonnect shall not be liable and / or responsible to any person for any loss, damage, costs, expenses, claims and / or liability arising in any form whatsoever due to any action taken by such person pursuant to such information, usage of such information.
  • PropKonnect reserve a complete right to amend, change and / or withdraw the information posted under the Builders/Property Owners//Rea Estate Brokers & Agents./Projects/Properties Listing.
  • All the properties and projects has been listed by our business partners to get maximum advertisement and marketing for them in order to visible them in front of the global real estate buyers.
  • All the enquiries received from the registered users will be supplied to the relevant builder/project owner, so that they can connect the property buyer and to give them accurate and complete details according to a user requirements.
  • PropKonnect is not building/constructing or selling any property or projects. It is our business partners who are the actual owners of different type of real estate properties.
  • The Sizes, Facilities/Amenities, Prices, Possession Dates and other property related details can be modified at any given point of time with/without any prior information for the users. We recommend to all our users to keep visiting the website or particular project regularly to be updated on real time basis.

Additional Terms and Conditions with respect to transactions by a Buying User

  • We understand that the Buying party is certain about the product which they are purchasing from our business partners.
  • You are required to make the upfront and detailed queries and questions on our website or with the property consultants to make sure you are doing the right deal.
  • You agree to be bound by the terms of enquiry listed in the item's description (or linked to from the description) when you submit your questions on our website, provided that these terms of sale do not violate this Agreement or the law..
  • PropKonnect strongly advises all users not to test the site with fraudulent transactions as this will expose you to significant personal legal danger, neither you nor your staff members nor associates should do so. Using a fake name or any other fraudulent personal information is illegal.

Additional Terms and Conditions with respect to Purchase by a CHANNEL PARTNERS (Individual/Business Owners)

  • Plan CHARGES- Each plan listed on our website for Channel Partners has the PRICE clearly mentioned over there, double check the same before purchase.
  • Plan VALIDITY- The VALIDITY of each plan for Channel Partners is explicitly stated on our website; please confirm before completing.
  • Plan FEATURE/OPTIONS- Every plan has its own features and usage; pick the one that best suits your needs.
  • Payment REFUNDS/RETURN- All the Payment once made against the purchase of any plan in completely NON-REFUNDABLE in any circumstance. We encourage to double-check the specific plan details, including features, use capabilities, and costs, with the plan validity to make sure they match the description and your needs. Once purchased, the plan cannot be canceled before its expiration date, and there are No-refunds for plans that have already been purchased.
  • All Sales Are Final- Purchase once made is FINAL in all manners as we do not honor any cancellations, correction, refunds in plan purchased by you and that is why we suggest to be 100% sure about what you place.

  • Cancellation Policy- There is NO Cancellation policy at PropKonnect. You will be able to see the details of your transactions under billing section in you dashboard. There are no cancellation fees from our end; but if there is any from bank end then it is the customer who is going to bear those charges. We advise and recommend to all of our clients that they should double check their orders as they are placed.
  • DISPUTE Resolution-
    a) Even though our terms and conditions regarding refund and cancellations are all spelled out in detail and are available above. Additionally, we are dedicated to ensuring that every customer is satisfied with our services and work with an objective to keep our consumers first. You can always send written suggestions and inputs to our customer care service at support@propkonnect.com in if you feel that we are not meeting your expectations and that you are not satisfied with the services, or if you have something that you would like to update. If you have any disputes, please send an email to support@propkonnect.com, and we will respond as soon as possible. To the best of our ability, we will resolve all disagreements politely and work to find the best solution for your issue.
    b) All notices given by the customers to PropKonnect must be given to SNAl Digital Media at #425, 4th Floor, Vipul Trade Centre, Sector-48, Sohna Road, Gurugram- 122018, Haryana, India – 122001 or be emailed at support@propkonnect.com. Same way PropKonnect may give notice to the customer on either the e-mail address or postal address that the customer provides to PropKonnect while registering and placing the order on our website, or in any of the possible ways. Notice will be deemed to be received and properly served immediately when sent by any medium like Email, Whatsapp or by Post, delivery of offline to your address or on your e-mail after 24 hours. All the medium of notices will be treated as delivered as specified by us.
    c) We will make every effort to settle any disputes within the allotted 30- to 45-day period, but if none of the parties' designated representatives are able to do so, either party may notify the other of its intention to begin arbitration, as provided below, regarding the matter at hand. If such notice is not given, no arbitration over this subject may begin. Arbitration will be used to settle any disagreement or dispute for which a notice of intention to begin arbitration has been given.
    A sole arbitrator is chosen by both parties to hear, consider, and settle the dispute; however, if the parties are unable to agree, the High Court of Gurugram will appoint one in accordance with Section 11 of the Arbitration and Conciliation Act, 1996, upon request from any of the parties on that matter.
    Any statutory amendments or re-enactments to the Indian Arbitration and Conciliation Act, 1996, as well as the rules established under it, must be followed when conducting arbitration procedures. In all circumstances and without exception, Raipur will be the only location for the arbitration. We assume that by seeing these terms and conditions, you have given your consent.
  • Law and Jurisdiction- The courts in Gurugram, Haryana, India, will have this exclusive jurisdiction. Indian law shall govern this Agreement, any dispute or claim arising out of or in connection with them, their subject matter, or their creation, even without a contract. Any dispute or claim arising out of or in connection with such Agreement or their formation (including non-contractual disputes or claims) shall be.

Violating these Terms of Service

  • If PropKonnect discovers a violation of the terms of use and determines that the incident can be fixed, PropKonnect will notify the affected user and ask them to fix the issue within 30 (thirty) business days of receiving the notice.
  • Without affecting its other rights, PropKonnect may suspend or delete the registration, terminate the account, restrict the user's access to all or part of the website, recover any financial losses to other users, if any, and take other appropriate action if the user fails to resolve the issues within 30 (thirty) business days of receiving the notice or violates any material provision of the Terms of Use.
  • If you are discovered to be in violation of our terms of usage or to be abusing our services, PropKonnect, in its sole discretion, has the right to restrict, suspend, or block your registration without providing an explanation. This covers, among other things, making up a false or fake profile, placing fictitious orders, abusing our messaging services, using your registration for fraudulent activities, using our website to conduct illegal activities, giving us only partial or inaccurate information about the company, violating any intellectual property rights, or engaging in any other behaviour that negatively impacts us.   • If a user is found to have violated the terms of use, they will be permanently blocked by us and will never be able to sign up again. Permanent account termination is possible, at PropKonnect's exclusive and exclusive discretion.

Both parties will remain independent of one another, and neither will have the authority to bind the other without the other's prior written consent.

  • For acts beyond its reasonable control, without its fault or negligence, neither party hereto shall be liable for any delays or failures in performance. Among other things, strikes, lockouts, riots, rebellions, unintentional explosions, floods, storms, acts of God, and similar catastrophes may produce such excused delays or failures.
  • According to their common understanding, the User and PropKonnect accept that the Terms of Use comprise the entirety of their agreement.
